摘 要
进口食品安全是指以进口方式进入到国内的进口食品不能有毒、不能有害,对人体健康不能造成任何慢性、亚急性或者急性危害,还要符合必须有的营养要求的一种安全状态。进口食品作为消费者在餐桌上随处可见的所食用一种,进口食品因高品质、高安全的特性广受消费者青睐。但随着世界科技的不断进步,进口食品安全问题也层出不穷,中韩进口食品安全也面临着挑战。在此环境下,本文通过比较分析中韩进口食品安全保障体系的主要内容,找出了我国进口食品安全保障体系中的存在的主要问题,并提出了相应的解决对策。 首先,关于进口食品安全法律法规方面,韩国进口食品安全法律法规体系完善、内容全面,法律位阶也高,并注重法律法规和食品安全标准的修改。我国的立法机关应当重视对进口食品安全相关法律法规的制定和更新,提高进口食品安全相关法律法规的位阶,并注重对进口食品相关法律法规的及时制定和修改,从而与国际接轨。 其次,关于进口食品安全监管体系方面,韩国进口食品安全监管职权集中、权限明确,进口食品安全的效能也高。我国的进口食品安全监管体系应进一步理顺,创新我国进口食品安全监管方式,提高进口食品安全监管的效率。 再次,关于进口食品风险分析及检验检测体系方面,韩国非常注重进口食品风险分析与管理,从而有效的保障进口食品安全,也非常注重对进口食品的检验检疫,为进口食品安全监管法律和政策的制定提供了充分的基础资料。我国进口食品安全保障中应突出风险分析和管理的作用,检验检测体系应与国际标准接轨。 最后,进口食品安全信息体系方面,韩国非常注重进口食品安全保障信息的统计分析和公开,公众可以充分享有对进口食品安全信息的知情权。我国应进一步完善进口食品安全信息统一公布制度,强调进口食品经营者的信息发布义务,信息发布应做到及时、准确、全面,充分保障公众的知情权。 |

Abstract
Imported food safety refers to the food imported into China can’t be toxic and harmful, can’t cause any chronic, subacute or acute harm to human health, and maintain a safe state that meets the nutritional requirements. As the food that can be seen everywhere on the table, imported food is widely favored by consumers because of its high quality and high safety. However, with the continuous progress of science and technology all over the world, issues of imported food safety are emerging one after another, and imported food safety of China-Korea is also facing challenges. In this case, the paper compares and analyzes the main contents of China-Korea imported food safety system, finding out the main problems and putting forward corresponding solutions. Firstly, for laws and regulations of imported food safety, the system in Korean is perfect with comprehensive content and high legal hierarchy, and it emphasizes the modification of laws, regulations and food safety standard. Legislative body in China should pay attention to the formulation and updating of relevant laws and regulations on imported food safety and improve its legal hierarchy. At the same time, we should focus on formulating and modifying the laws timely so as to be geared to international standards. Secondly, for supervision system of imported food safety, the supervision power in Korea is centralized and clear, and the efficiency is also high for the supervision of Korean imported food. Chinese supervision system of imported food safety should be further straightened out to innovate the way of supervision and improve its efficiency. Thirdly, for risk analysis and inspection system of imported food, Korea attaches great importance to risk analysis and management on imported food so as to guarantee their safety effectively. Meanwhile, Korea also focuses on the inspection and quarantine to imported food, which provides sufficient basic data for formulating supervision laws and policies for imported food safety. The role of risk analysis and management should be highlighted in the safety guarantee of Chinese imported food and the inspection system should be in line with international standards. Finally, for information system of imported food safety, Korea lies stress on the statistical analysis and disclosure of the information of imported food safety so that the public can fully enjoy the right to know the news about the imported food safety. China should further improve the unified disclosure system of the information of imported food safety and emphasize the imported food operators’ information release obligation. Information release should be timely, accurate and comprehensive, and the right to know for the public should be fully guaranteed. |
